These Terms govern your access to and usage of all content, products, and services available at miamibeachfingerprinting.com (the “Service”) operated by Miami Beach LiveScan Fingerprinting, LLC (“us,” “we,” or “our”).

Your access to our services is subject to your acceptance, without modification, of all of the terms and conditions contained herein. Please read this Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.

1. Service Description & Government Disclaimer

Miami Beach LiveScan Fingerprinting, LLC is a private service provider approved by the Florida Department of Law Enforcement (FDLE) to capture and submit biometric data. We are not a government agency.

• Processing Times: We do not control the processing speed of the FDLE, FBI, or AHCA Clearinghouse. While we submit records immediately, government processing times vary and are outside our control.
• Outcome: We do not review or influence the results of your background check. We simply transmit the data you provide.

2. User Responsibilities & Accuracy

You are responsible for providing complete and accurate information during your appointment.

• ORI Numbers: You must provide the correct Originating Agency Identifier (ORI) number. Submitting fingerprints to the wrong ORI number cannot be reversed, and a new appointment with a new payment will be required to correct it.
• Identification: You must present a valid, unexpired government-issued photo ID and proof of your Social Security Number (if applicable) at the time of service.
• Data Verification: You are required to verify all data typed into the Live Scan system (Name, DOB, SSN) before the transmission is sent. We are not liable for data entry errors once you have verified and signed for the submission.

3. Appointments, Cancellations & Refunds

• Cancellations: We respectfully request at least 24 hours notice for cancellations or rescheduling.
• No-Shows: Failure to appear for your appointment without notice may result in the forfeiture of any deposit paid.
• Refunds: Once fingerprints have been captured and transmitted to the state/federal database, services are non-refundable. Government fees (FDLE/FBI charges) are paid immediately upon transmission and cannot be recovered.

4. Intellectual Property

The Agreement does not transfer any of our or third-party intellectual property from Us to you. All rights, titles, and interests in and to such property will remain (as between the parties) solely with Miami Beach LiveScan Fingerprinting, LLC and its licensors.

5. Third-Party Services

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (e.g., appointment scheduling software, payment processors).

If you use any Third Party Services, you understand that:

• Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
• You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

6. Termination

We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimer

Our Services are provided on an “AS IS” and “AS AVAILABLE” basis. Miami Beach LiveScan Fingerprinting, LLC and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Miami Beach LiveScan Fingerprinting, LLC, nor its suppliers and licensors make any warranty that our Services will be error-free or that access to them will be continuous or uninterrupted.

8. Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of the State of Florida, USA. The state and federal courts located in Miami-Dade County will be the proper venue for any disputes arising out of or relating to the Agreement.

9. Changes

At our sole discretion, Miami Beach LiveScan Fingerprinting, LLC reserves the right to modify or replace these Terms at any time. If we make material changes, we will let you know by posting on our website or sending you an email or other communication before the changes take effect. Your continued use of our Services will be subject to the new terms.
